AEIP welcomes the EU eDeclaration proposal and calls for targeted enhancements to ensure fair posting and compliance

The European Association of Paritarian Institutions (AEIP) welcomes the European Commission’s proposal to establish a single digital declaration portal (eDeclaration) as a significant step toward streamlining procedures and reducing administrative burdens for companies posting workers across the EU. By replacing 27 fragmented national systems with a multilingual platform, this initiative has the potential to make cross-border mobility fairer and more transparent.
However, to ensure the portal effectively addresses existing challenges and supports both companies and workers, AEIP recommends the following key improvements:
- AEIP cautions against a fully standardised approach that could weaken enforcement and undermine fair posting. Instead, AEIP supports an optional interface that builds on well-functioning national systems, ensuring full interoperability within the Internal Market Information System (IMI) for Member States that do not adopt the eDeclaration system. This approach would safeguard fair posting and competitiveness in the Internal Market.
- The interface should reduce administrative complexity while ensuring fair posting and competitiveness. AEIP recommends integrating existing compliance tools (ESSPASS, DC4EU) to align PDA1 and posting declarations, mandating the sharing of posting declarations with workers, and strengthening cross-border cooperation through targeted inspections and improved coordination between national authorities.
- To ensure fair posting, AEIP supports the information required in the standard form and recommends expanding it to include working conditions, remuneration, social security, health and safety, posting duration, accommodation, and travel costs. AEIP also calls for ongoing collaboration with national sectoral social partners to ensure the information remains relevant and effective.
- To strengthen compliance and cooperation, AEIP recommends that Member States grant national sectoral paritarian funds, alongside social partners, access to relevant IMI data, including posting declarations. This would enhance compliance monitoring, prevent social dumping, improve cross-border cooperation, and eliminate duplicate payments for posted workers.
- AEIP suggests coordinating the development of the public interface with ELA’s initiatives, including the EU helpdesk and improved national websites on posting, to streamline notifications and enhance access to clear and standardised information.
AEIP Director Simone Miotto, emphasized the added value of the paritarian model in supporting companies and posted workers in complying with regulations and promoting fair mobility:
“Sectoral paritarian funds play a key role in ensuring fair remuneration and working conditions for posted workers under Directive (EU) 2018/957. Granting national paritarian institutions access to posting declarations data will improve compliance monitoring, enhance cross-border cooperation, and help prevent social dumping.”
AEIP remains committed to engaging in constructive dialogue with the European co-legislators and the European Commission to ensure that the eDeclaration portal effectively reduces administrative burdens for companies and workers involved in posting. At the same time, AEIP advocates for measures that strengthen the European Internal Market and labour mobility while safeguarding fair posting conditions and compliance with existing social and labour protections.
